These Terms and Conditions govern your use of the Iris Health AI platform and services. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, please do not use our services.

Services

Iris Health AI provides a patient education platform that delivers procedure-specific educational content to surgical patients on behalf of healthcare provider organizations. Our services include educational video delivery, secure tokenized patient access links, SMS delivery facilitation, and engagement analytics reporting.

Eligibility

Our platform is intended for use by licensed healthcare provider organizations and their authorized staff. By using our services you represent that you are authorized to do so on behalf of your organization.

SMS Messaging Terms

Iris Health AI facilitates SMS delivery of patient education content on behalf of healthcare provider organizations. By enrolling patients in SMS communications you confirm that appropriate patient consent has been obtained. Message and data rates may apply to recipients. Patients may opt out at any time by replying STOP to any message. For help reply HELP or contact us at rebecca@irishealthai.com.

Acceptable Use

You agree to use Iris Health AI solely for lawful purposes and in accordance with these terms. You agree not to use our platform in any way that violates applicable laws or regulations, transmits unauthorized PHI through our platform, attempts to gain unauthorized access to any part of our system, or interferes with the proper functioning of our services.

Intellectual Property

Iris Health AI retains ownership of the platform, delivery methodology, and all proprietary technology. Healthcare provider organizations retain ownership of clinical content developed in collaboration with Iris Health AI. Neither party may use the other's intellectual property without prior written consent.

Privacy and Data

Your use of our platform is also governed by our Privacy Policy located at irishealthai.com/privacy. By using our services you agree to the terms of our Privacy Policy.

Disclaimers

Iris Health AI provides an educational content delivery platform and does not provide medical advice. Educational content is developed in collaboration with and approved by licensed healthcare providers. Iris Health AI is not responsible for clinical outcomes related to patient use or non-use of educational materials.

Limitation of Liability

To the maximum extent permitted by applicable law, Iris Health AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services. Our total liability shall not exceed the amounts paid by you to Iris Health AI in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Iris Health AI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Modifications

We reserve the right to modify these terms at any time. We will notify active users of material changes. Continued use of our platform following notification constitutes acceptance of the revised terms.

Governing Law

These terms shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.
